Imlay Twp. man arrested at work for CSC, has history of prior offenses

A man who spent 46 days in Sanilac County Jail for assault was arrested at his Imlay City workplace last Monday, August 14, for four counts of criminal sexual conduct against a 20-year-old Imlay City victim.

Michael Charles Lee McFadden, age 40 of Imlay Township, was arraigned in Lapeer County court the following day on one count of first degree criminal sexual conduct, two counts of third degree criminal sexual conduct, one count of fourth degree sexual conduct and one count of assault to do great bodily harm less than murder.

Both the first degree and third degree counts are considered felonies, with McFadden facing a possibility of life in prison if found guilty of the first degree charge. He could also receive 10 years of prison time for the felony assault charge.

McFadden was arrested while at work for Hickory Square Apartments, owned by Lapeer-based NuHorizon Properties, LLC, with the company placing him on suspension. Despite his 2022 conviction and serving of time, with McFadden having been present for a probation review hearing just three weeks before his arrest, the company allegedly did not complete a background check, even as McFadden admitted to being convicted of “just a misdemeanor” on his application.

McFadden had been working for the company since February of this year, with him meeting and victimizing the 20-year-old resident through his job as building maintenance.

Imlay City Police Chief Brett Selby noted that the crimes McFadden had pled no contest to in March 2022, the two misdemeanor charges of assault, would have come up in a simple Google search, along with coverage by local media about the charges dropped against him in the same case— four charges of first degree criminal sexual conduct, two counts of second degree criminal sexual conduct and one third degree count of criminal sexual conduct, all which was allegedly committed against a minor in 2019.

McFadden was given a $250,000.00 bond in the 71-A District Court and a preliminary court date of August 28th at 2pm. He is also due back in Sanilac County Circuit Court on October 10 at 8:00 a.m. for another probation review hearing, with it currently unclear how the new charges will affect his case.
