Bound over to Tuscola County Circuit Court two weeks ago, a Caro man accused of killing his one-year-old son in February will have an August trial if a plea is not reached.
Arrested on February 10, 2024, 27-year-old Brian Stewart Elswick is facing five charges, including a count each of open murder and first degree child abuse, and three counts of lying to a police officer, following the abuse and death of his one-year-old child. With a similar incident on his record from October 2022, he is being held on a $500,000 bond as he waits for his jury trial on August 29.
At the beginning of this month, Tuscola County Judge Amy Gierhart scheduled a plea cut off hearing and stipulated that attorneys and the defendant must be present at the hearing. Earlier this year, Elswick had a competency hearing, during which District Court Judge Jason E. Bitzer deemed Elswick competent to face his charges.
He is scheduled to appear again in court on July 29, for the plea cutoff hearing.
