Michigan Attorney General Dana Nessel announced Monday that a Genesee County man was recently found guilty on three weapons charges and six charges of criminal sexual conduct against an underage girl in Tuscola County.
John Digiacomo, age 59 of Clio, committed the assaults against the girl back in 2014 and 2015, supplying her with narcotics and threatening to kill her and her family when she attempted to cut ties with him or otherwise protect herself. For his crimes, he was convicted of:
- two counts of first-degree CSC, felonies punishable by life in prison;
- one count of second-degree CSC, a felony punishable by 15 years in prison;
- two counts of third-degree CSC, felonies punishable by 15 years in prison;
- three counts of weapons felony firearm, punishable by 2 years in prison; and
- one count of fourth-degree CSC, a high court misdemeanor punishable by two years and/or a $500 fine.
The assaults allegedly happened in multiple places across Tuscola, Genesee and Saginaw Counties, with Digiacomo scheduled for trial in Genesee County on March 14. He is charged with the following:
- four counts of first-degree criminal sexual conduct (CSC), felonies punishable by life in prison;
- one count of second-degree CSC, a felony punishable by 15 years in prison;
- four counts of third-degree CSC, felonies punishable by 15 years in prison;
- one count of fourth-degree CSC, a high court misdemeanor punishable by two years and/or a $500 fine;
- one count of assault with a dangerous weapon; a felony punishable by four years and/or a $2,000 fine; and
- one count of felony firearm, a felony punishable by two years consecutively with and preceding any term of imprisonment imposed for the felony or attempted felony conviction.
Sentencing has not been scheduled by Tuscola County yet. The case is being prosecuted by the Attorney General Cold Case Sexual Assault Project.
